JUSTICE SHAMIMA JAHAN ORDER 22.09.2025 Heard Mr. K.K. Handique, learned counsel for the petitioner and Mr. R. Kaushik, learned counsel for the State as well as Ms. G. Swami, learned counsel for Page No.# 2/4 the informant. By this application, the petitioner has prayed for bail in connection with Dispur P.S Case No. 553 of 2025 registered under Section 69 of BNS, 2023. The FIR 02.07.2025 reveals that the victim who was working in a private organization got acquainted with the petitioner through social media and had developed a love relationship with him. It is also alleged that the petitioner had visited the parents of the victim and had proposed marriage with the victim before them and that thereafter, the petitioner went to the house of the victim and had developed physical relationship with her against her will. It is also alleged that the petitioner on the pretext of marrying the victim had developed physical relationship with her. It is also alleged that that the petitioner had decided to marry someone else instead of the victim and when the victim confronted the petitioner, the petitioner threatened her that he would make intimate photograph viral and also would kill her. Mr. Handique, learned counsel for the petitioner submits that the allegations made in the FIR are concocted and that there was no ingredients of Section 69 of the BNS being attracted in the instant case. Mr. R. Kaushik, learned counsel for the State however submits that the Case Diary would reveal the actual story projected in the instant FIR and has prayed for Page No.# 3/4 calling of the same. Ms. G. Swami, learned counsel for the informant submits that the allegations in the FIR are serious and that the petitioner has threatened her to publish the intimate photograph of the victim and the petitioner and as such has prayed that no bail may be granted to the petitioner. It is reflected in the FIR that the petitioner and the victim had developed love relationship after they met on social media and had developed physical relationship in pursuance of the same. In view of the submissions made above and the contents of the FIR, this Court finds it fit that the petitioner may be released on bail on furnishing a bail bond of Rs. 20,000/- with one (1) local surety of the like amount to the satisfaction of the learned CJM, Kamrup (M) under the following conditions:- (1) He will not approach the victim or any of the victim’s family members. (2) He will not tamper with the evidence or influence the witnesses. (3) He will not leave the jurisdiction of the learned CJM, Kamrup (M) without the permission of the said Court.
