[2025:RJ-JP:26171] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 7389/2021 Smt. Priyanka Kumari W/o Shri Manoj Kumar Ambesh, Aged About 28 Years, R/o Vikas Nagar, Bharatpur (Raj.) ----Petitioner Versus 1. State Of Rajasthan, Through Principal Secretary, Public Health And Engineering Department, Government Of Rajasthan, Secretariat, Jaipur. 2. Chief Engineer (Administration), Public Health And Engineering Department, Jal Bhawan, Hasanpura, Jaipur. 3. Rajasthan Technical University, Kota, Through Its Registrar. 4. Chandrawati Education Charitable Trust, Through Its Registrar Nh-11, Sewar Bye Pass, Near Dalmiya Dairy, Bharatpur (Raj.) ----Respondents For Petitioner(s) : Mr. Prakhar Agarwal For Respondent(s) : Mr. Narendra Kumar Saini for respondent No.3 HON'BLE MR. JUSTICE SUDESH BANSAL Order 14/07/2025 1. Matter has come up on an application (1/2024) for early listing, however, with the consent of counsel for both parties, the writ petition has been heard finally on merits. 2. By means of filing instant civil writ petition under Article 226 of the Constitution of India, petitioner has raised a grievance for non-sanctioning of the study leave as per Rules 110 & 112 of Rajasthan Service Rules, 1951, to complete her B.Tech course from the Rajasthan Technician University, Kota. 3. Admittedly, petitioner is a student in B.Tech course through Lateral Entry in Engineering Programme (LEEP) -2014 in the batch of 2013 and as per Rule, she is required to complete her B.Tech Course upto the Academic Year 2021-2022. [2025:RJ-JP:26171] (2 of 2) [CW-7389/2021] 4. It has transpired that after undergoing B.Tech course upto III Semester (II year), petitioner got appointment on the post of Junior Engineer (Civil) on 11.06.2015 and got posting at the Office of Assistant Engineer, PHED, Nagar Block, Alwar. Petitioner prayed to grant study leave, but since her case was not found within the purview of Rule 110 of the Rules of 1951, no study leave was sanctioned. At this juncture, petitioner has approached before this Court. 5. It is an admitted situation that in the meanwhile, the year for completion of B.Tech course upto 2021-2022 has expired. 6. On behalf of Rajasthan Technician University, Kota- respondent No.3, counsel has put in appearance and submits that now petitioner cannot be allowed to continue and complete her B.Tech course, since for the batch of 2013 through LEEP-2014, one chance to clear the B.Tech course as a mercy chance was given in the year 2021-2022 in view of the, 33rd Special Academic Council meeting dated 31.07.2021 (Annx.R/1). 7. Counsel for petitioner is not in a position to dispute that petitioner was required to complete her B.Tech course upto the Academic Year 2021-2022, hence, now the prayer for seeking study leave to complete the B.Tech course has become infructuous. 8. Accordingly, the writ petition is disposed of as rendered infructuous. 9. All pending application(s), if any, also stand(s) disposed of. (SUDESH BANSAL),J NITIN/ RONAK/268
