1. The instant petition under Section 29-A, Arbitration and Conciliation Act, 1996 and the SFCA Rules, 2006 has been filed by the petitioner seeking extension of time to the Arbitral Tribunal of Sole Arbitrator Dr. H.L.Bajaj for another period of six months (w.e.f. 02.02.2025 onwards) for completion of arbitration proceedings.

It is averred that this Court vide order dated 08.04.2021 passed in Arbitration Application No. 23 of 2014 has referred the dispute in relation to the Contract dated 26.02.2011 inter se the parties to the institutional arbitration of SCOPE Forum and accordingly the proforma respondent vide its communication dated 14.12.2022 constituted the Arbitral Tribunal comprising Dr. H.L.Bajaj, Former Chairman, Central Electricity Authority & Ex-Officio Secy. To Govt. of India, as its Sole Arbitrator; that the parties to the dispute Sr. No. 25

have presented themselves before the Tribunal and filed respective Claim/Counter Claim. It is further averred that the claimant/petitioner herein has concluded its argument in second session of the proceedings conducted by the learned Arbitral Tribunal on 04.01.2025 and the matter is now posted for final
arguments on behalf of the respondent; that in terms of the said order dated 04.01.2025 it has been directed by the learned Arbitral Tribunal to seek further extension/enlargement of time for a period of six months beyond the extended time period in this regard expiring on 01.02.2025 and prayed for extension of time to the Arbitral Tribunal for another period of six months w.e.f. 02.02.2025 for completion of arbitration proceeding between the parties.
3. Notice. Mr. Rakesh Chargotra, learned counsel accepts notice on behalf of the respondents, who submits that he has no objections in case this petition is allowed.
4. Heard learned counsel for the parties at length and scrutinized the record.
5. In view of the submissions made by learned counsel for the parties, this petition is allowed by extending further period of six months from 02.02.2025 to the Arbitral Tribunal comprising Sole Arbitrator Dr. H.L. Bajaj, for completion of Arbitration Proceedings between the parties in accordance with law. A copy of this order be supplied to the sole Arbitrator, namely, Dr. H.L. Bajaj.
