HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9550 of 2025 Court No. - 2 HON'BLE MRS. SANGEETA CHANDRA, J. HON'BLE AMITABH KUMAR RAI, J. Heard learned counsel for the petitioners at some length and learned Standing Counsel, who appears on behalf of the State-Respondents and has produced the instructions dated 23.09.2025 sent by Sub Divisional Magistrate, Mitauli, Kheri. The petitioners have prayed for a writ of mandamus to be issued to the respondent nos.2 to 4 to allow them to harvest the standing crops over the land in question and to restrain the respondents from auctioning the land which has been allotted to the petitioners. After arguing at some length, learned counsel for the petitioners says that the appeal of the petitioners is pending before the Commissioner, in which no interim order has been granted and the next date fixed is 26.10.2025. He, therefore, does not wish to press this writ petition and seeks to pursue the appropriate remedy which he has already availed. The writ petition is dismissed as withdrawn.
