NARENDRA PRASAD ORAL ORDER This writ petition is filed by defendant Nos. 5 and 6 under Article 227 of the Constitution of India, seeking a direction to the trial court to decide additional issue No.1 and re-cast issue No.6 as a preliminary issue in O.S.No.8212/2019. - 3 - NC: 2025:KHC:16141 WP No. 6891 of 2025 2. The plaintiff filed a suit for recovery of possession. After service of summons, defendants appeared through counsel and filed the written statement. On the basis of the pleadings of the parties, the trial court has framed additional issue No.1 in respect of maintainability of the suit and also re-cast issue No.6 which is also on maintainability. The matter was posted for hearing the additional issue No.1 and re-cast issue No.6 as a preliminary issue. Thereafter, the trial court directed that the preliminary issue can also be considered along with the other issues. 3. The only grievance of the petitioners is that since the court has already posted the matter for consideration of preliminary issue, the matter can be decided first as a preliminary issue. 4. The learned counsel for the respondent No.1/plaintiff filed a memo and contended that the plaintiff has no objection to consider additional issue No.1 and re- cast issue No.6 as a preliminary issue. - 4 - NC: 2025:KHC:16141 WP No. 6891 of 2025 5. In view of the above, this writ petition is disposed of directing the trial court to first decide the additional issue No.1 and re-cast issue No.6, on merits, in accordance with law, after giving opportunity to both the parties.
