HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 12107 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J.
1. Heard learned counsel for petitioner and Mr. Diwakar Singh, learned State Counsel appearing on behalf of the opposite parties.
2. Present petition under Article 226 of Constitution of India has been filed seeking a direction to authority concerned to determine seniority of petitioner on the post of Designated Officer with effect from 21.04.2014 pertaining to vacancy of selection year 2012-13.
3. Learned State Counsel has raised a preliminary objection regarding maintainability of this petition in view of fact that seniority list of the said post was admittedly issued in year 2016 but neither order rejecting petitioner's objections against the tentative seniority list has been challenged nor the seniority list itself.
4. In view of such objections being raised, learned counsel for petitioner seeks to withdraw the petition with liberty to file afresh.
5. Considering such submission, petition is dismissed as withdrawn granting liberty to petitioner to file afresh before the appropriate forum.
