Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State-respondents. 2. It has been contended on behalf of the petitioner that though the measurement had been carried out on the spot pursuant to order dated 31.10.2023 passed by the Sub-Divisional Magistrate, Ram Nagar, Barabanki under the proceedings instituted under Section 24 of the U.P. Revenue Code, 2006 but immediately thereafter, the Gram Pradhan of the gram sabha concerned, had started construction of the Khadanja over the bhumidhari land of the petitioner. 3. Learned Standing Counsel though has submitted that the aforesaid contention of learned counsel appearing for the petitioner is not correct but he could not produce any document to show that no construction of Khadanja had been carried out on the spot in question. 4. Having considered the overall facts and circumstances of the case, we hereby direct the Sub-Divisional Magistrate concerned to carry out a spot inspection and if it is found that the Khadanja was not existing on the land in question and new construction of khadanja had been made by the Gram Pradhan of the gram sabha Versus Counsel for Petitioner(s) : Arvind Kumar Counsel for Respondent(s) : C.S.C., Mohan Singh Salil Kumar .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Revenue Lko. And 4 Others .....Respondent(s) concerned then he will do the needful and will remove the khadanja. 5.
