Learned passed the impugned order of termination would further submit that the subject covered by the Order dated 15.11.2021 passed by a Coordinate Bench of this Court in Ch.Baby v,s. As seen from the above instructions, the Respondent - Authorities while passing the impugned order, have not afforded any opportunity to the Petitioner to show cause as to why the proposed punishment shall not be imposed. The order of termination was passed only on the basis of note approval of the Project Officer, ITDA, Rampachodavaram, without issuing any The Order passed by a Coordinate Bench of this Court in W.P.No.1015 of 2019, is squarely applicable to the present case. In such, circumstances, the impugned order is liable to be set aside. 6. Accordingly, the Writ Petition is disposed of setting aside the Memo NO.195/A4/2018, dated 16.08.2019, with a liberty to the Respondents to pass appropriate order after issuing show-cause notice and considering the explanation, if any, of the Petitioner thereon, within a period of six weeks from I.T.D.A, notice. the date of receipt of a copy of this order.
