1. Heard Mr. S.C. Biswas, learned counsel for the accused/petitioner. Also heard Mr. B. Sharma, learned Additional Public Prosecutor, Assam.
2. By this petition under Section 483 BNSS, the petitioner, namely, Sajidur Rahman @ Sajid Uddin, who was arrested on 26.06.2025 in connection with
Page No.# 2/2 Badarpur P.S. Case No. 55/2025 in correspondence with G.R. Case No. 431/2025, under Section 70(2) of the BNS, 2023 read with Section 6 of the POCSO Act seeks bail .
3. It is submitted that the statutory period of detention of 90 days is already over.
4. The learned Additional Public Prosecutor on instruction received submitted that the charge-sheet has not yet been submitted. Hence the petitioner is entitled to default bail.
5. Accordingly, it is provided that the accused petitioner, named above, shall be released on default bail of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of like amount to the satisfaction of learned Special Judge, POCSO, Sribhumi subject to the following condition- i) That the accused petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court.
6. The bail application stands disposed of.
