Ajay Mohan Goel, Judge (Oral) Despite repeated calls, as none is appearing for the respondent, accordingly, he is proceeded against ex parte. 2. By way of this petition, the petitioner has assailed the order passed by learned District Judge (Family Court), Shimla, in terms whereof, an application filed by her under Section 24 of the Hindu Marriage Act was rejected on the ground that in terms the statement made by the petitioner on oath on 01.06.2019 before the Court of learned Additional Sessions Judge-cum-Special Judge (CBI), Shimla, she has accepted the maintenance to the tune of Rs. 37,000/- per month for herself and for her children and stated that she shall not be claiming any further amount other than the settled amount. 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:27811 3. Taking into consideration the fact that this order was passed in the year 2019, on the basis of statement made by the petitioner in the proceedings, which were initiated by her under Section 125 of the Code of Criminal Procedure, as was stated at the bar by learned Counsel for the petitioner, these proceedings are disposed of with the observation that an endeavour be made by learned Court below to decide the petition filed under Section 13 of the Hindu Marriage Act expeditiously and the petitioner is at liberty to again file an appropriate application, seeking maintenance/ enhanced maintenance, in lieu of the time lapse and the order passed by learned Court below, which is assailed by way of this petition, shall not come in the way of the learned Court below in passing appropriate order thereupon in the changed circumstances.
