The instant writ petition has been filed by the petitioners with the following prayer:- (I) by an appropriate writ, order or direction, the non- petitioners may kindly be directed not to raise any public way/road through the khatedari land of the [2025:RJ-JP:19489] (2 of 2) [CW-10544/2014] petitioners bearing khasra No. 3579 of village Deorala, Tehsil Srimadhopur, District Sikar. (ii) by further appropriate writ, order or direction, the non-petitioners may kindly be directed not to evict the petitioners from their khatedari land bearing khasra No. 3579 of village Deorala, Tehsil Srimadhopur, District Sikar. (iii) any other or direction as may be deemed fit and proper in the facts and circumstances of the case may also be passed in favour of the humble petitioners. (iv) cost of this writ petition may also be awarded in favour of humble petitioners.” 2. By way of filing this writ petition, the petitioners are seeking direction against the respondents not to raise any public way/road through the khatedari land bearing khasra No. 3579 situated at Village Deorala, Tehsil Shrimadhopur, District Sikar. 3. At the outset, counsel for the respondents submitted that the through land bearing Khasra No. 3579, no construction activity of roads are being under taken rather the construction activity of the roads are going to be taken on Khasra No. 3582 and the road is required to be constructed, adjacent to the boundary of Khasra No. 3570 and 3578. 4. Considering the above reply submitted by the counsel for the respondents, this Court finds that no cause of action survives with the petitioners to continue with this petition and the present petition is dismissed as having become infrctuous. 5. However, the petitioners would be at liberty to approach the appropriate forum of law by way of filing appropriate application in case, any cause of action/grievance still survives. 6.
