Upon instructions, Mr. S.A. Ahmed, learned counsel for the petitioner submits that the statement made in paragraph 5 of this interlocutory application is found to be incorrect and therefore, he prays for liberty to withdraw this interlocutory application and file afresh. Mr. K. Gogoi, learned CGC for the respondent nos.1; Mr. H. Kuli, learned counsel appearing on behalf of Mr. A.I. Ali, learned standing counsel for respondent no.2; Mr. G. Sarma, learned standing counsel for the FT matters, representing respondent nos.3, 4 and 6; Mr. P. Sarma, learned Additional Senior Govt. Advocate for respondent no.5 are present. The learned standing counsel for the FT matter has submitted that he has received specific instruction that the mother of Superintendent of Police (B) Baksa had not died on the date alleged in paragraph 5 of the interlocutory application.
Page No.# 3/3 Be that as it may, as the petitioner seeks to withdraw this application, the prayer for withdrawal is allowed. Accordingly, this interlocutory application stands dismissed on withdrawal with liberty, as prayed for.
