CRM(A) 1265 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sagarpara P.S. Case No.517 of 2024 dated 24.12.2024 under Sections 4/8/18 of the POCSO Act. And
In the matter of: Rajbul Ali @ Taton Sk. … petitioner
Mr. J.I. Hossain … for the petitioner.
Mr. Kaushik Kundu
Md. Ejaz Akhter … for the State
Report filed by the State is taken on record. Despite service no one appears on behalf of the de facto complainant.
Learned counsel appearing for the petitioner submits that the petitioner and the victim are neighbours. Due to some previous grudge the petitioner and his brother have been falsely implicated in this case. The brother was granted anticipatory bail by the Sessions Court.
Learned counsel for the State relies on the statement of the victim recorded before the learned Magistrate. The same implicates the present petitioner. The role of the other brother is only that he came to make “shalisi.”
2 In view of the materials available in the case diary and the role ascribed to the petitioner, I am not inclined to grant anticipatory bail to the petitioner. The application for anticipatory bail is, thus, rejected.
