Sri Pradeep Kumar, learned Advocate submits, he is counsel for opposite party no.2 but his name has wrongly shown as counsel for applicant. 2. Sri D.S. Pandey, learned counsel for applicant, Sri Pradeep Kumar, learned counsel for opposite party no.2 and Sri Vijay Bahadur Maurya, learned AGA for the State are present. 3. The instant transfer application has been filed by the applicant with a prayer to transfer the proceedings of Complaint Case No. 14400 of 2023, under Sections 323, 504, 506 IPC, Police Station Bhitauli, District Maharajganj pending in the court of Chief Judicial Magistrate, Maharajganj to District Court Kushi Nagar. 4. At the very outset, learned counsel for applicant submits, in the instant transfer application, applicant has made a prayer to transfer the proceedings of complaint case pending against applicant from District Maharajganj to District Kushi Nagar but proceedings of complaint case has been stayed by this Court in 482 Cr.P.C. application filed by the applicant, therefore, instant transfer application has become infructuous and the same may be dismissed as infructuous. 5. Learned AGA as well as learned counsel for opposite party no.2 are having no objection. 6. In view of the submission made by learned counsel for applicant, the instant transfer application stands dismissed as infructuous.
