Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Ravi Kumar Shukla, learned counsel for the respondent nos. 3 & 4. 2. Sri Ravi Kumar Shukla, learned counsel for the respondent nos. 3 & 4 has produced the instruction after providing the copy of same to learned counsel for the petitioner, which is taken on record. On the basis of that, he submitted that earlier for the very same dispute, petitioner has filed Writ-C No.27093 of 2021, which was disposed of vide order dated 8.2.2024 with direction to respondents to take decision. In pursuance of that, District Magistrate, Deoria vide order dated 25.1.2025 has decided the issue and remanded the matter back to Executive Officer, Nagar Palika Parishad, Deoria to pass fresh order. Accordingly, Executive Officer, Nagar Palika Parishad, Deoria has passed order on 8.10.2025. He next submitted that against the said order, petitioner has efficacious remedy to file appeal under Section 160 of U.P. Municipal Act, 1960, therefore, present petition is not maintainable and liable to be dismissed. 3. At this stage, learned counsel for the petitioner submitted that the petition may be dismissed with liberty to challenge the order dated 8.10.2025 for which learned counsel for the respondents has no objection. 4. Under such facts and circumstances, the writ petition is dismissed with the aforesaid liberty.
