MOHAMMAD GHALIB SHAHID Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Court made the followl'n Order:- ¢`\ \ This Criminal Petition, under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/Accused Nos.3 to 6, seeking anticipatory bail, in connection with crl'me No.9 of 2025 of Bandlamo{u police station, palnadu District, registered for the offence punishable under section 109(1) r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Petitioners herein are arrayed as accused Nos.3 to 6 in aforesaid crime. The dispute is with regard to disposal of waste water. The accused and de facfo complainant appeared to have entangled in quarrel on 28.01.2025 at 7:30 P.M. All the accused alleged to have armed with sticks and stones, attacked the de facfo complainant and caused bleeding injuries. This Court with respect to accused Nos.1 and 2, in same crime, has granted regular bail I-n CrI.P.No.2008 of 2025 dated 13.03.2025_ 3. Learned counsel for the petitioners submits that even as per the c/e facfo complainant, allegation made against the petitioners is that due to pelting of stones, de facfo complainant has sustained minor inJ'urieS. A Coordinate Bench of this court, while granting regular bail has consI'dered the aforesaid aspect, based on the wound certificate indicating that there were lacerations. Victim has already been discharged from hospital. As already the investigat,-on is almost completed, learned counsel seeks to grant anticipatory bail. c-_,, Jf' •aJ 4. Learned Assistant Public Prosecutor opposing the aforesaid submissions, contends that the allegations made against the petitioners are serious in nature and as per wound certificate there is a clear bleeding injury. Therefore, it is not a fit case for granting anticipatory bail. 5. This Court while granting regular bail to accused Nos.1 and 2, who are prime accused, has considered the aspect of wound certificate and nature of injuries sustained to the cye facfo complainant. Having regard to the fact that eleven witnesses were examined and investigation is at an advanced stage, they are entitled to be enlarged on bail in the event of their arrest. 6. In view of the same, the Criminal Petition is a//owec/ with following conditions: (a) In the event of arrest of petitioners, the petitioners shall be enlarged on bail on executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties for a like sum each to the satisfaction of the arresting police officials; (b) The petitioners shall appear before the Station House Officer, concerned, thrice in a week i.e., on Monday, Wednesday and Saturday between 10.00 a.m. and 05.00 p.m., till fI'Iing of the charge sheet; (c) The Petitioners are directed not to hamper the investigation and tamper with the prosecution witnesses; `\. --, ERIE (d) The petitioners shall make themselves available for investI'gatiOn aS and when required,a (e) It is made clear that the petitioners sha" scrupulously comply with the above condl-lions and breach of any of the above conditions will be viewed seriously and prosecutl-on is at liberty to move an application for cancellation of the bal'I.
