Heard Sri Wahaj Ahmad Siddiqui, learned counsel for the petitioner and learned Standing Counsel. By means of present petition filed under Article 226 of the Constitution, petitioner has prayed prayed for writ of mandamus commanding respondent authorities not to threaten the demolition of standing construction of the petitioner over and above plot no 585 situate at Kampil Mauja, Kyamganj, Farrukhabad. Learned Standing Counsel has obtained instructions in the matter and placed the same before this Court, which are taken on record, copy whereof is also supplied to the learned counsel for the petitioner. From the instructions, it transpires that three member committee has already submitted report that no demolition exercise is being carried out at plot no. 585, the order passed under Section 67 of U.P. Revenue Code, 2006 is being executed in respect of plot no. 605 only where unauthorized construction has been raised. In view of above, stand taken by the State authorities, we do find any good reason to pass order any further in the matter. Petition is accordingly stands disposed of in the light of stand taken by the State respondents.
