HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 34211 of 2025 Court No. - 69 HON'BLE ARUN KUMAR SINGH DESHWAL, J.
1. Heard Sri Hemendra Pratap Singh, learned counsel for the applicants, Sri Rakesh Kumar Mishra, learned A.G.A. for the State and Sri Shashi Kant Shukla, learned counsel for the informant and perused the record. 2. Instant bail application has been filed with a prayer to release the applicants on bail during the trial in Case Crime No. 338 of 2022, under Sections 504, 506, 326A I.P.C., Police Station- Shivpur, District Varanasi. 3. Contention of learned counsel for the applicants is that applicants were also named in the FIR alongwith two co-accused persons. After investigation, police submitted the charge sheet against only two persons and applicants were exonerated. Thereafter, during trial applicants were summoned under Section 319 Cr.P.C. on the same nature of allegation. It is further submitted that co-accused Chandan Singh has already been enlarged on bail by a co-ordinate Bench of this Court in Criminal Misc. Bail Application No.20915 of 2023 vide order dated 16.06.2023. Therefore, he is seeking parity of the order aforesaid. The applicants have no criminal history at the time of lodging of the present case and he is languishing in jail since 29.08.2025, therefore, they are entitled to be enlarged on bail. In case, they are granted bail, they will not misuse the liberty of bail and would cooperate in the trial proceedings. . 4. Per contra, learned A.G.A. for the State and learned counsel for the informant vehemently opposed the prayer for bail and submit that criminal revision against the summoning order in Section 319 Cr.P.C. has already Versus Counsel for Applicant(s) : Abhijeet Pratap Singh, Hemendra Pratap Singh, Kuldeep Singh Counsel for Opposite Party(s) : G.A., Shashi Kant Shukla Shatrughan Subash Singh And Another .....Applicant(s) State of U.P. .....Opposite Party(s)
been allowed. Therefore, bail of the applicant no.1 has become infructuous. However, as on date the order of quashing summoning order in Section 319 Cr.P.C. at the instance of applicant no.1 is not on record. 5.
Thus, considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and keeping in view the nature of offence, evidence, complicity of accused and without expressing any opinion on the merits of the case, I am of the opinion that the applicant is entitled to be enlarged on bail. 6. Let the applicants- Shatrughan Subash Singh and Dhananjay Laxmikant Singh involved in the aforementioned crime be released on bail, on their furnishing a personal bond and two sureties each in the like amount, to the satisfaction of the court concerned, with the following conditions:- i.
