This is the first bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 94/2025 registered at Police Station – Kondagaon, District- Kondagaon (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111 and 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. Prosecution case in brief is that the information was received from the Cyber Crime reporting that various mutual funds holders are involved in online fraud including one of the co-accused who is holder of Saraswati Jewelers are receiving illegal money through online mode amounting to PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.05.15 16:23:57 +0530 2 Rs. 99,59,056/- and on investigation it was found that for profit the applicant has given his account to the co-accused for carrying out the online cyber fraud. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in the present case. He further submits that the as per the instruction given, no money has been received by the applicant and his involvement was that he has assisted in meeting of the other co-accused and there was no active involvement of the applicant and he has not received any unlawful gain from the alleged transaction. Further, the applicant has no previous criminal antecedents, the charge-sheet has been filed and the applicant is in jail since 13.03.2025, trial is likely to take some time for its conclusion therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of bail to the applicant and submitted that the charge-sheet has been filed. She further submitted that various mutual funds holders are involved in online fraud including one of the co-accused who is holder of Saraswati Jewelers are receiving illegal money through online mode amounting to Rs. 99,59,056/- and on investigation it was found that for profit the applicant has given his account to the co-accused for carrying out the online cyber fraud, hence the bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties and from perusal of the record, it appears that the involvement of various mutual fund holders in online fraud, including one of the co-accused who is holder of Saraswati Jewelers are 3 receiving Rs. 99,59,056/- illegal money through online mode, it is evident that the applicant knowingly provided his account to the co-accused for profit, facilitating organized cyber fraud, hence, the bail application of the applicant is rejected. 7. Accordingly the bail application of the applicant, namely, Indrajeet Badai involved in Crime No. 94/2025 registered at Police Station – Kondagaon, District- Kondagaon (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5), 111 and 3(5) of Bharatiya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
