3. Thereafter a writ petition was filed by Shivam Tiwari, which is still pending. Meanwhile, claim of the petitioner was considered for financial approval and on basis of an order passed by this Court in the earlier round of litigation, financial approval was granted vide order dated 6.2.2025.
4. Now the petitioner has approached this Court that it ought to have been granted with effect from the date of her initial appointment.
5. Learned counsel for the petitioner is not able to Canvas before this Court that either Committee of Management or said respondent were intentionally on default, due to which there was delay of 5 years in granting financial approval regarding petitioner's Versus Counsel for Petitioner(s) : Arvind Kumar Srivastava, Shrikant Srivastava Counsel for Respondent(s) : C.S.C. Ms Utkarsh Verma .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s)
appointment, as well as matter was pending before concerned respondent, who decided it, therefore, a prayer that her financial approval be considered with effect from the date of her appointment is not liable to be considered. In normal circumstances, date of financial approval is the relevant date.
6. Reliance placed by counsel for the petitioner on a judgement of a co-ordinate Bench in Writ Petition No.10689 of 2024, Sita Ram Sharma and 13 Others Vs. State of U.P and 3 Ors, (Neutral Citation No.2025 AHC: 59424) will not be helpful since facts of the said case are absolutely different, therefore, prayer of the petitioner as sought cannot be granted.
7. Writ Petition is accordingly dismissed.
