Also heard Mr. A. M. Khan, learned counsel for the opposite party No. 1/writ petitioner and Mr. S. Dutta, learned Standing Counsel, P & R.D Department for opposite party Nos. 2 to 5. By filing this application, the applicant prays for impleadment as party respondent No. 5 in the connected writ petition, being WP(C) No. 4586/2025. The opposite party No. 1/writ petitioner has filed the connected writ petition, being WP(C) No. 4586/2025, challenging the re-tender issued vide NIT dated 25.07.2025 in respect of Sutarpara Pashuhat on the ground that the petitioner was found eligible in the 1st tender, being NIT dated 05.06.2025, and without completion of settlement process of the 1st tender, the respondent authorities have issued the 2nd tender dated 25.07.2025 with a view to settle the market in favour of certain favoured persons. The applicant claims to be one of the bidders in the 2nd tender, which is Page No.# 3/3 under challenge in the writ petition. Having considered that the challenge made in the connected writ petition, being WP(C) No. 4586/2025, is to the 2nd tender dated 27.05.2025, in which the applicant has stated to have participated, I am of the considered view that the applicant is a necessary party to the connected writ proceedings. Accordingly, the applicant is allowed to be impleaded as respondent No. 5 in the connected writ petition, being WP(C) No. 4586/2025. Interlocutory application stands allowed and disposed of.
