…...... 02/ 16.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 191(2)/ 191(3)/ 190/308(5)/ 352/351(2)/ 303(2) of B.N.S., 2023. 3. It is alleged that particular land in question was purchased by Ankit Kumar Rai and the informant was looking after the same. It is alleged that on 16.04.2025, when the informant went to make some construction over the land, several persons named in the F.I.R. came and obstructed him with weapons and demanded Rs.25 lakhs. Again on 21.04.2025, the same incident happened where several persons named in the F.I.R. and unknown came and obstructed him. 4. Admittedly, petitioner is not named in the F.I.R. He is said to be one of those 32 to 40 unknown persons who were part of the mob. 5. The learned APP opposes the prayer for anticipatory bail and after going through the case-diary, admits as per the document which were produced that the land in question was purchased by one Yasodha Devi, W/o Sri Sidheswar Narayan Sinha. It is the case of the petitioner that
Yasodha Devi is mother of Manoj Kumar Sinha one of the named accused persons. He submits that since this petitioner is friend of Manoj Kumar Sinha, he has also been implicated in this case and the police is daily visiting his house to arrest him. 6. Considering the aforesaid fact and also the fact that there is no allegation of assault upon any one, I feel that this is a fit case for grant of anticipatory bail of the petitioner. 7. Accordingly, this Anticipatory Bail Application stands allowed.
The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Deoghar, in connection with Rikhiya P.S. Case No.83 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 8. Petitioner should cooperate and join investigation and appear before the Investigating Officer once in 15 days. (ANANDA SEN, J.) R.S./
