HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 15790 of 2025 Court No. - 35 HON'BLE PRAVEEN KUMAR GIRI, J.
1. The petitioner has filed the present writ petition with the following prayers:
"A writ order or direction in the nature of Certiorari for quashing the impugned order dated 25.07.2017 passed by respondent no.3 and directing the respondents (specially the respondent no.3) to pass an appropriate order regarding renewal of the petitioner on her post i.e. Instruction (Agriculture) in his institution and be further pleased to direct the respondents to make the payment of honorarium of the petitioner to them, when it falls due. ii. A writ order or direction in the nature of Mandamus directing the respondents (specially the respondent no.3) to pass an appropriate order regarding renewal of the petitioner on her post i.e. Instruction (Agriculture) in his institution and be further pleased to direct the respondents to make the payment of honorarium of the petitioner to them, when it falls due."
2. This writ petition has been filed after a long gap, as the petitioner had worked as a contractual employee with renewal year to year basis from 13.07.2013 to 06.07.2015, thereafter, the petitioner left his post and now he claims that he had sought leave but the same was not sanctioned. 2. Per contra, learned counsel for the respondents submits that the petitioner has approached this Court after a gap of 10 years and the post of the petitioner was only for one year, until and unless it is renewed as Versus Counsel for Petitioner(s) : Lalit Prakash, Yashasvi Shukla Counsel for Respondent(s) : C.S.C., Shivendra Kumar Singh Pushpendra Kumar .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s)
per his conduct. It is apparent that he has been absent for more than 10 years. Accordingly, the claim of an employee whose service is renewed each year based on his conduct and, apparently, the conduct of the petitioner is not good as he did not opt to continue his service immediately for the cause he is now alleging in this petition for renewal of his service. 3. This Court cannot renew petitioner's service after 10 years, as in his place some other person might have been engaged for teaching the children of poor villagers. Therefore, the claim of the petitioner for renewal of his post as Instructor (Agriculture) cannot be considered. 4.
This Court is taking a lenient view as the petitioner was an Instructor (Agriculture), otherwise, this Court might have imposed a cost of Rs. 1,00,000/- on the petitioner. 5. Accordingly, the writ petition is dismissed without any cost. October 29, 2025 K.Tiwari WRIA No. 15790 of 2025 2 (Praveen Kumar Giri,J.)
