Heard the counsel for the petitioner and the A.G.A. representing the respondent nos. 1, 2 and 3. The present petition has been filed challenging the impugned first information report dated 16.07.2025 registered as Case Crime No. 271 of 2025, under Sections 319(2), 318(4), 338, 336(3), 340(2) B.N.S., Police Station- Bairia, District- Ballia. It has been argued by the counsel for the petitioner that petitioner is a mere computer typist appointed on contractual basis and he has been implicated only to save the higher officials in the matter. It has been further argued that no offence under the provisions in which FIR has been registered, is made out against the petitioner. The AGA has opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the first information report dated 16.07.2025 registered in Case Crime No. 271 of 2025, Under Sections 319(2), 318(4), 338, 336(3), 340(2) B.N.S., Police Station- Bairia, District- Ballia till submission of the police report under Section 193 of BNSS, 2023.
