Sri Kaushlendra Pandey, learned counsel for applicant, Sri Somveer, learned Advocate holding brief of Sri Ashvani Kumar Tiwari, learned counsel for opposite party no.2 and Sri Shatruhan Yadav, learned AGA are present. 2. The instant transfer application has been filed by the applicant with a prayer to transfer the proceedings of Criminal Case No. 5692 of 2021, arising out of Case Crime No. 1099 of 2016, under Section 406 IPC, Police Station Kavinagar, District Ghaziabad pending in the court of Additional Chief Judicial Magistrate Court No.5, Ghaziabad to District Court Aligarh. 3. At the very outset, learned counsel for applicant submits, applicant is accused in a criminal case and he filed instant transfer application to transfer the case from District Ghaziabad to District Aligarh but applicant is ready to pursue the matter through Video Conferencing and therefore instant application may be disposed off with the direction that if applicant filed an application before appropriate forum to appear through Video Conferencing then his application shall be entertained and he will be permitted to appear through Video Conferencing. 4. Learned AGA as well as learned counsel for opposite party no.2 are having no objection. 5. The instant transfer application has been filed by the applicant, who is accused in criminal case to transfer the case from District Ghaziabad to District Aligarh but now he is ready to appear through Video Conferencing, therefore, instant transfer application is being disposed off with a direction Versus Counsel for Applicant(s) : Kaushlendra Pandey Counsel for Opposite Party(s) : Amit Mishra, Ashvani Kumar Tiwari, G.A.
