It is submitted that the applicant has been falsely implicated in the present case due to village party bandi only due to the fact that he had friendship with Priyanka the elder sister of the victim and the informant had full knowledge about it and thus he has been implicated, para 9 of the affidavit has been placed before the Court. Per contra, learned counsel for the State opposed the prayer for bail and submitted that the applicant is named in the FIR and also in the statements of the victim recorded during investigation and there are allegations of rape against him. The victim is a minor girl. It is submitted that the present case is a case of gang rape. It is further submitted that co-accused Sachin has been apprehended from the place and handed over to the police and has received injuries after jumping from the second floor of the house but the applicant somehow taking help of a grill managed to run away. It is submitted that there is no reason for false implication of the applicant and as such the prayer for bail of the applicant be rejected. 8. After having heard learned counsels for the parties and perusing the records, it is evident that the victim is a minor girl. The present case appears to be a case of gang rape. The applicant is named in the FIR and also in the statements of the victim recorded during investigation and there are allegations of rape against him. Co-accused Sachin has also been assigned identical role who was apprehended on the spot and had jumped from the second floor of the house and received injuries. I do not find it a fit case for bail. 9.
Considering the totality of the case in particular, nature of evidence available on record, I am not inclined to release the applicant on bail. 10. The bail application is, accordingly, rejected. 11.
