Banik, the learned counsel appearing on behalf of the petitioner. Mr. S.R. Baruah, the learned Government Advocate appears on behalf of the District Administration and Mr. P. Sarma, the learned Standing Counsel appears on behalf of the Fishery Department. 2. This Court vide an order dated 16.09.2025 enquired with the learned counsels appearing on behalf of the respondents, as to whether, the Notice Inviting Tender is in consonance with the order dated 21.05.2025 passed in Special Leave to Appeal (Civil) No. 18318/2024 by the Supreme Court as well as the Office Order dated 10.07.2025 issued by the Secretary to the Government of Assam, Fishery Department. 3. Today, Mr. S.R. Baruah, the learned Government Advocate submitted that the Notice Inviting Tender is in consonance with Page No.# 3/4 the order passed by the Supreme Court dated 21.05.2025 in Special Leave to Appeal (Civil) No. 18318/2024 as well as the Office Order dated 10.07.2025 issued by the Secretary to the Government of Assam, Fishery Department. In that regard, the learned Government Advocate has placed before this Court, the Terms and Conditions of the Notice Inviting Tender dated 22.08.2025 as well as the Tender Form which is also required to be filed. 4. This Court further taking into account the Tender Documents is of the opinion that there has been due compliance. 5. This Court, however, finds it very pertinent to take note of that the petitioner herein has assailed the Notice Inviting Tender, but for reasons best known has not enclosed the entire Notice Inviting Tender which contains the Terms and Conditions. 6. Mr. S. Banik, the learned counsel appearing on behalf of the petitioner submitted that inadvertently the entire Tender Document could not be filed. He therefore submitted that he may be permitted to withdraw the instant writ petition with a liberty to re-file challenging the Terms and Conditions of the Tender Documents. 7. Taking into account the above, the instant writ petition Page No.# 4/4 stands closed on withdrawal. 8. However, liberty is given to the petitioner to re-file on the same cause of action.
