Heard Sri Shubham Prakash Gupta, learned counsel for applicant, Ms. Priyanka Devi, learned counsel for the opposite party no.2 and Dr. S.B. Maurya, learned A.G.A. for the State. 2. The instant transfer application has been filed by the applicant with a prayer to transfer the Case No. 10064 of 2023 (State of U.P. Versus Heena and others), arising out of Case Crime No.0506 of 2023, Under Sections 147, 452, 308, 504 and 506 I.P.C., Police Station Loni, District Ghaziabad, pending in the Court of Additional Chief Judicial Magistrate, 1st Ghaziabad to Additional Chief Judicial Magistrate, Rampur having competent jurisdiction. 3. At the very outset, learned counsel for applicant submits, however, applicant is the informant of the case and he filed the instant transfer application with the prayer to transfer the trial of the case from District Ghaziabad to District Rampur but now applicant is ready to appear through video conferencing and, therefore, instant transfer application may be disposed of with the direction that if applicant filed an application before appropriate forum to appear through Video Conferencing then his application shall be entertained and he will be permitted to appear through Video Conferencing. 4. Learned A.G.A. as well as learned counsel for the opposite party no.2 Versus Counsel for Applicant(s) : Mukesh Chandra Gupta, Shubham Prakash Gupta Counsel for Opposite Party(s) : Dev Prakash Sharma, G.A., Priyanka Devi Mohd Azam .....Applicant(s) State Of Up And 5 Others .....Opposite Party(s) are having no objection. 5. In view of the contention raised by learned counsel for the applicant, instant transfer application stands disposed of with the direction that that if applicant filed an application to pursue the matter through Video Conferencing then his application shall be considered and he will be permitted to pursue the matter through Video Conferencing.
