The Petitioner claims that the Respondent No.3 had issued a house site patta to the Petitioner vide proceedings dated 06.05.1982 to an extent of 166 Sq.yds bearing Plot No. 78 bounded by North- Plot No.77, East: Plot No.79, South: Road and West: Road in Sy.No.27, Block No.II under the provisions of Board Standing Orders No.21. The Petitioner has obtained electricity service connection and she was paying bills regularly and also property tax to the Respondent Authorities. 3. While so, the staff of the Respondents 2 and 3 in the fourth week of August, 2014 insisted the Petitioner to vacate the house site premises stating that she has no right over the property. Hence, the present Writ Petition came to be filed. 4. Along with the Writ Petition, the Petitioner has filed copy of a Patta granted in her favour and property tax for the said house. This Court on 04.09.2015 granted interim order directing the Respondent No.3 not to interfere with the possession and enjoyment of the Petitioner without following procedure as recognized under law. 5. No counter-affidavit has been filed by the Respondent Authorities, even after elapse of 11 years. 6. Considering the Patta issued in favour of the Petitioner on 06.05.1982 and the house tax receipts, this Court is inclined to dispose of the Writ Petition in terms of interim order dated 04.09.2014, directing the Respondents not to interfere with the possession and enjoyment of the Petitioner over the subject property i.e bearing Plot No.78, D.No.11-103/2, situated in Sy.No.27, Block II, Madhuravada, Chinnagadula Mandal, Visakhapatnam District, except in accordance with procedure as recognized under law. 7. The present Writ Petition, is therefore, disposed of. No order as to costs.
