Heard Sri Pranab Kumar Ganguli, learned counsel appearing for the petitioner and Sri Pradeep Kumar Shahi, learned Additional Chief Standing Counsel for the State respondents. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for a writ of mandamus to command respondent no. 3 to immediately release the payment which is due to be paid to the petitioner for the construction of road that he has carried out as per the Work Order dated 21.7.2023 and 24.3.2023. 3. It is contended that there is no dispute regarding claim of the petitioner for the amount to the paid to him for the construction activity that he has carried out under the agreement but the amount is not being paid only for reason that the budged for the financial year 2022-2023 during which the work was carried out has already lapsed. 4. Learned Additional Chief Standing Counsel at this stage submits that petitioner though has made a representation to the respondent no. 4 but the competent authority in the matter is respondent no. 2. In the circumstances, if he choose to move an appropriate representation before the said authority, the said authority be directed to dispose of the said representation in accordance with law. 5. In view of the above, we dispose of this petition with a direction to the Versus Counsel for Petitioner(s) : Ashutosh Ganguli, Pranab Kumar Ganguli Counsel for Respondent(s) : C.S.C. Vipin Kumar .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) petitioner in the first instance to move an application/representation before the respondent no. 2 raising all his claims and grievances within four weeks from today and in the event, he makes such a representation as directed hereinabove, the said respondent no. 2 shall dispose of the same strictly in accordance with law. 6. It is further provided that in the event petitioner's claim is found to be rightful and genuine, the entire payment shall be disbursed to him within a further period of four months.
