GP FOR SERVICES I 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 15718 of 2021 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents particularly the 4th respondent in interfering with the personal liberty of the petitioner by misusing his official capacity as Sub-Inspector of Police, in calling the petitioner to police station without registering any criminal case against the petitioner and in threatening with dire consequences of implicating him in false criminal cases on the allegation that the petitioner secured job by submitting fake VII class certificate inspite of the conclusion of enquiry twice where under the certificate submitted by the petitioner declared as genuine, as illegal, arbitrary, unjust, discriminatory, without jurisdiction and also in violation of the principles of Natural Justice and to consequently direct the respondents particularly the 4th respondent not to interfere with the personal liberty of the petitioner by misusing his official capacity as Sub-Inspector of Police in any manner including calling the petitioner to the police station and threatening him to implicate in false criminal cases….” 2. Heard Sri K.Jyothi Prasad, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that the 4th respondent in interfering with the personal liberty of the petitioner and threatening with dire consequences of implicating him in false criminal cases on the allegation that the petitioner secured job by submitting fake VII class certificate inspite of the 4 conclusion of enquiry twice where under the certificate submitted by the petitioner declared as genuine. 4. Learned Assistant Government Pleader for Home would submit that the police are not interfering with personal liberty of the petitioner and the Court may pass appropriate Orders. 5. Considering the submissions made, this Writ Petition is disposed of. However, the police are directed not to interfere with the life and liberty of the petitioner by making false allegations against his 7th Class Certificate, which was certified by the MEO, as genuine. There shall be no order as to costs.
