HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 33340 of 2025 Court No. - 39 HON'BLE ARINDAM SINHA, J.
HON'BLE SATYA VEER SINGH, J.
1. Mr. Shailesh Kumar Shukla, learned advocate, appears on behalf of petitioner. He submits, his client was wrongfully taken into custody. He made application dated 25th August, 2025 to Human Rights Commission to make inquiry for purpose of awarding compensation. He seeks direction to compel the Commission to enquire, report and award compensation.
2. Mrs. Shubhra Singh, learned advocate, Standing Counsel appears on behalf of State. On query she submits, petitioner was not taken into custody. She hands up her instructions with copy to Mr. Shukla.
3. We do not deem it necessary to direct issuance of notice on private respondent, who was the then officiating Incharge Inspector, Police Station Soraon in Commissionarate Prayagraj. As petitioner says he was wrongfully taken into custody without issuance of arrest memo, we think it is a fit case for re-directing petitioner to make application to the Human Rights Commission. Petitioner will make application before the Human Rights Commission for initiating inquiry into his allegation of wrongful arrest. This is because on further query we have ascertained from Mr. Shukla that final report was filed on 29th April, 2020. On still further query Mr. Shukla Submits, petitioner had applied before the Sessions Court and followed up thereafter by filing the writ petition. As such, petitioner will enclose relevant documents, including copy of the application dated 25th August, 2025, in the fresh application to be made Versus Counsel for Petitioner(s) : Ashok Kumar Maurya, Shailesh Kumar Shukla Counsel for Respondent(s) : C.S.C.
