HIGH COURT OF JUDICATURE AT ALLAHABAD HABEAS CORPUS WRIT PETITION No. - 926 of 2025 Court No. - 88 HON'BLE VINOD DIWAKAR, J.
1. Heard learned counsel for the petitioner, learned A.G.A. for the State- respondent, and perused the record.
2. The present petition has been preferred by petitioner no. 2 seeking a direction to the respondent no.4 to produce the petitioner no. 1 (corpus), with whom he claims to have solemnized marriage on 01.07.2025 at Arya Samaj, Prayagraj.
3. Learned counsel for the petitioner submits that petitioner no. 1 (corpus) has been illegally detained by her father (respondent no. 4), who has allegedly taken her away forcibly. Aggrieved thereby, the petitioner has approached this Court by way of the present petition.
4. Without entering into the veracity of the factual assertions and the legality of the alleged marriage, it's observed that petitioner no. 1 is a major, aged about 22 years. In the absence of any cogent material suggesting coercion or illegal confinement, mere custody of a major daughter by her father cannot be treated as unlawful detention.
5. In view of the above, the present petition lacks merit and is, accordingly, dismissed. October 14, 2025 Anil K.
