HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 10278 of 2025 with S.C.C. REVISION No. - 151 of 2022 Hitesh Suri …..Revisionist(s) Versus Ram Prakash Gupta …..Opposite Party(s) Counsel for Revisionist(s) : Siddhartha Srivastava Counsel for Opposite Party(s) : Ashish Pandey, Rajesh Gupta, Virendra Kumar Jaiswal Court No. - 36 HON'BLE ROHIT RANJAN AGARWAL, J. Versus Counsel for Petitioner(s) : Jay Prakash Yadav Counsel for Respondent(s) : Ram Prakash Gupta .....Petitioner(s) Hitesh Suri .....Respondent(s) 1. Heard Sri J.P. Yadav, learned counsel for the petitioner and Sri Siddharth Srivastava, learned counsel for the revisionist in S.C.C. Revision No. 151 of 2022. 2. Learned counsel for the petitioner submits that parties have compromised and possession has been handed over by tenant to landlord. 3. Sri Srivastava, learned counsel for tenant also does not dispute the fact that the present petition has been filed for a direction to decide the Execution Case No. 559 of 2024. 4. According to petitioner's counsel, as the decree has been partially executed and possession has already been handed over the only dispute remains as to deposit made by tenant before court below. He wants that money so deposited be released in favour of landlord-petitioner. 5. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of along with S.C.C. Revision No. 151 of 2022 directing the executing court to proceed with application moved by landlord-petitioner for release of money deposited before court as possession has already been handed over by tenant to landlord, and decide the same, expeditiously within one month, from the date of production of certified copy of this order. 6. With the aforesaid direction, writ petition stands disposed of. 7. It is made clear that this Court has not adjudicated the matter on merits.
