THIS PETITION, COMING ON ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.6 in S.C.No.184/2022 pending before the Court of VI Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru, arising out of Crime No.262/2021 registered by Electronic City Police Station, for the offences punishable under Sections 120(B), 143, 144, 147, 148, 150, 341, 427, 307, 302, 149 of IPC read with Sections 4 and 25 (1B) (b) of the Arms Act, 1959, is before this Court under Section 483 of BNSS seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent. 3. FIR in Crime No.262/2021 was registered by Electronic City Police Station, Bengaluru City against accused and two others initially for the offences punishable - 3 - HC-KAR NC: 2025:KHC:22958 CRL.P No. 3100 of 2025 under Sections 341, 427, 307, 302, 120B, 34 of IPC read with Sections 4 and 25 (1B) (b) of the Arms Act, 1959 based on the first information received on 28.12.2021 from Thridev son of Aravind. 4. During the course of investigation of the case, the petitioner herein was arrested on 03.01.2022 and subsequently remanded to judicial custody. After completing the investigation, the charge sheet has been filed against ten accused and petitioner has been arraigned as accused No.6. The bail application filed by the petitioner in Crl.P.No.11111/2022 was rejected on 25.01.2023 and the subsequent bail application filed by the petitioner in Crl.P.No.4101/2023 was dismissed on 14.06.2023. Under these circumstances, the petitioner is before this Court in this successive bail application. 5. Learned counsel for the petitioner submits that all the material charge sheet witnesses including the injured witnesses have turned hostile to the case of the - 4 - HC-KAR NC: 2025:KHC:22958 CRL.P No. 3100 of 2025 prosecution. Accused Nos.1 to 5 and 7 to 10 have been enlarged on bail. Accordingly, he prays to enlarge the petitioner on regular bail. 6. Per contra, learned HCGP, who has opposed the petition, does not dispute the submission made by the learned counsel for the petitioner. 7. Perusal of the material on record would go to show that the petitioner is in custody from 03.01.2022. C.Ws.1 to 4 and 6, who are the material charge sheet witnesses in the present case have been examined before the Trial Court and they have completely turned hostile to the case of the prosecution. Accused Nos.1 to 5 and 7 to 10 have been enlarged on bail by this Court in Crl.P.Nos.5238/2025 and 5320/2025, 3338/2025 and connected petitions. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. (ii) The petitioner is directed to be enlarged on bail in S.C.No.184/2022 pending before the Court of VI Addl. District & Sessions Judge, Bangalore Rural arising out of Crime.No.262/2021 registered by Electronic Police Station, Bengaluru City for the offences punishable under Sections 120(B), 143, 144, 147, 148, 150, 341, 427, 307, 302, 149 of IPC read with Sections 4 and 25 (1B) (b) of the Arms Act, 1959, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR NC: 2025:KHC:22958 CRL.P No. 3100 of 2025 d) The petitioner shall not involve in similar offences in future; SD/- (S VISHWAJITH SHETTY) JUDGE PKS List No.: 1 Sl No.: 50
