In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Suri PS Case No.94 of 2025 dated 13.02.2025 under Sections 85/103/3(5) of the of the BNS 2023.
And In the matter of: Sk. Manjoor @ Manjur Sk & another.
….Applicants/Petitioners. Mr. Milon Mukherjee, Sr. Adv. Mr. Sanjib Kumar Dan …for the petitioners. Mr. Rudradipta Nandy, APP Ms. Ankita Paul
..for the State
Learned senior counsel representing the petitioners submits as follows. The petitioners are the husband and the sister in law of the victim deceased. The victim committed suicide by hanging after twelve years of marriage. The FIR was registered pursuant to a direction passed by a learned Magistrate under Section 175 (3) of the BNSS Act. There was no other injury present in the dead body as would be evident from the post mortem report.
Learned counsel appearing on behalf of the State relies on the statements and the witnesses and the post mortem report.
Considering the tenor of statements made by the witnesses, the post mortem report and the fact that there was no complain of misdemeanor lodged during twelve years of married life, I do not think that custodial interrogation of the petitioners is required in this case.
2
In view thereof, the prayer for anticipatory bail is allowed.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall meet the Investigating Officer of the case as and when required and shall not try to influence the witnesses or threaten them.
The application for anticipatory bail is, thus, disposed of.
