C482/854/2015 Hon’ble Alok Mahra, J.
Mr. Vikramaditya proxy counsel for Mr. Sanjeev Singh, learned counsel for the applicant.
2. Mr. Vinod Joshi, proxy counsel for Mr. Neetu Singh, learned counsel for respondent.
3. This petition under Section C-482 Cr.P.C. has been filed by the applicant to quash the impugned
judgment and order dated 16.03.2015 passed by learned District and Sessions Judge, Haridwar in Criminal Revision N. 456 of 2014 ‘Bharat Verma Vs. State of Uttarakhand and Others’.
4.
Learned counsel for the applicant would submit that Criminal Complaint Case No. 954 of 2013 titled Ram Kumar Vs. Bharat Verma was filed under Section 138 of the Negotiable Instruments Act, 1881, in the court of the learned Additional Chief Judicial Magistrate, Laksar, wherein the applicant was summoned under the said provision. Subsequently, the complainant/respondent preferred Criminal Revision No. 456 of 2014 (Bharat Verma Vs. State of Uttarakhand and Others) before the learned District and Sessions Judge, Haridwar. The revisional court set aside the trial court's dismissal order dated 06.02.2014 under Section 203 C.r.P.C. and remanded the matter back to the trial court.
5. Perusal of the record reveals that a letter dated 19.07.2024, issued by the Incharge Additional Chief Judicial Magistrate/Civil Judge (Senior Division), Laksar, District Haridwar, has been placed on file in which it is stated that Criminal Case No. 954 of 2013 was again dismissed under Section 203 CrPC on
30.03.2015.
6. In view of the above, nothing survives for
consideration in the present application under Section 482 CrPC.
6. Accordingly, the present application under Section 482 CrPC is dismissed as infructuous.
