Also heard Learned DSGI, Mr. B. Majumder appearing on behalf of respondent Nos.1, 4 & 5. None appeared on behalf of respondent Nos.2 & 3 inspite of service of notice. Heard both the sides. The matter is taken up for hearing and disposal. The petitioners of this case have filed this writ petition seeking the following reliefs: “(i) ISSUE RULE calling upon the respondents and each one of them, to show cause as to why a Writ of Certiorari and/or in the nature thereof, shall not be issued for calling for the records, lying with the officials respondents, for rendering substantial and conscionable justice to the petitioners and for quashing/ setting aside the impugned Notification No. F. No. A. VI-1/2025-Rectt(SSB)-CT/GD-2025, dated (Annexure-2 infra) and the PET/PST examinations conducted in correspondence thereto for candidates from Tripura along with any results thereof; 08.08.2025 (ii) ISSUE RULE calling upon the respondents to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued for mandating/directing the respondents to revoke/rescind the impugned Notification No. F. No. A. VI-1/2025-Rectt(SSB)-CT/ GD-2025, dated 08.08.2025 (Annexure-2 infra), whereby intimation of conduct of the Physical Efficiency Test (PET) and Physical Standard Test (PST) events for the Constable 11 (GD) Examination-2025 in CAPFs, SSF, Rifleman (GD) in Assam Rifles, and Sepoy in NCB for CBE qualified/shortlisted candidates was notified, and to further revoke/ rescind the entire conduct of the said PET/PST tests held in AR Aizawl, 34 Assam Rifles, Aizawl, Mizoram, for the candidates from Tripura, and thereafter, to conduct fresh PET/PST tests for the Petitioners and similarly situated candidates from Tripura at venues in Agartala, Tripura, such as the Assam Rifles Ground, Agartala or CRPF Group Centre, Adarani, Agartala, ensuring proper and fair conditions, including standardized tracks and adequate safety measures; (iii) ISSUE RULE calling upon the respondents to show cause as to why a Writ of Prohibition and/or in the nature thereof, shall not be issued for prohibiting the respondents from acting in furtherance of the results of the conduct of the Physical Efficiency Test (PET) and Physical Standard Test (PST) examinations held pursuant to the impugned Notification No. F. No. A. VI- 1/2025-Rectt(SSB)-CT/GD-2025, dated 08.08.2025 (Annexure-2 infra), and from proceeding with any results, selections, or subsequent recruitment stages arising from the PET/PST tests conducted in AR Aizawl, 34 Assam Rifles, Aizawl, Mizoram, for the candidates from Tripura; (iv) After hearing the parties, be pleased to make the Rules absolute in terms of Prayer (ii) above; AND/OR (v) Any other relief(s) as to this Hon'ble High Court may deem fit and proper; AND For such gracious act of kindness, the humble petitioners, as in duty bound, shall ever pray.” At the time of hearing, Learned Counsel for the petitioners drawn the attention of the Court that the present petitioners against the advertisement dated 05.09.2024 for the post of constable (GD) in Central Armed Police Forces (CAPFs) (Annexure-A) applied for those posts and after scrutiny of their applications, admits cards were issued in favour of the petitioners along with other eligible candidates, directing them to appear for written examination (computer-based examination) scheduled to be held on various dates w.e.f. 04.02.2025 to 25.02.2025. After issuance of the admit cards, the petitioners along with other eligible candidates appeared for the written examination on their 12 respective scheduled dates. On 17.06.2025, the result of the written examination was declared and the petitioners were duly qualified in the said examination. After that according to Learned Counsel, on 12.08.2025 although it was signed on 08.08.2025 (Annexure-2) DIG Recruitment CRPF vide No.F.No.A.VI-1/2025- Rectt(SSB)-CT/GD-2025 issued one notice (Annexure-2). For the sake of convenience, the relevant portion of notice is mentioned herein below: Central Reserve Police Force F. No. A.VI-1/2025-Rectt(SSB)-CT/GD-2025 (Nodal Force) Important Notice The PET/PST events of CT(GD) Exam-2025 in CAPFs, SSF, Rifleman (GD) in Assam Rifles and Sepoy in NCB for CBE qualified/shortlisted candidates is scheduled from 20/08/2025 onwards. The E Admit cards for PET/PST stage can be downloaded by shortlisted candidates from the link https://www.crpfonline.com/const qd capfs nia ssf assam rifle 2025 pet pst 0104.php available on CRPF website (i.e. https://rect.crpf.gov.in). All candidates are directed to bring printed copy of E-Admit card at the time of PET/PST. Candidates will not be permitted for PET/PST without their Admit Cards. (Reference: SSC write up No. HQ-C-3007/5/2025-C-3 dated 17/06/2025) Referring the same, Learned Counsel for the petitioners, Mr. Majumder submitted that although the same was signed on 08.08.2025 but actually it was uploaded in the website on 12.08.2025 wherein it was directed by the respondent- authority for physical efficiency and physical standard test scheduled to be held w.e.f. 20.08.2025 to 28.08.2025 and to appear for those tests at Mizoram. It was further submitted that since from the year 2012-2024 in such type of examination, the physical standard test and physical efficiency test used to be taken at Agartala for the candidates of these region. But this time, 13 the authority selected the place at Mizoram, Aizawl and the altitude of Agartala, Tripura and the altitude of Mizoram are totally different, resulting which when the petitioners appeared for the said tests, they developed certain physical discomforts and although they appeared in the exam but due to breathing and some other problem, they could not qualify the exam, resulting which the present petitioners have been seriously prejudiced and submitted that the ‘doctrine of legitimate expectation’ was not been followed in this case. According to Learned Counsel, if such type of examination could take place at Agartala, in that case there was every possibility that the petitioners could qualify the physical standard test and physical efficiency test but for choosing the venue at AR Aizawl, 34 Assam Rifles, Aizawl, Mizoram the petitioners became unsuccessful in the exam for which they have compelled to file this writ petition before this Court praying for revocation/rescind of the impugned notification dated 08.08.2025 (Annexure-2). It was further submitted that in this matter Assam Rifles was not a necessary party because the examination was conducted by SSC. So, Learned Counsel for the petitioners urged for allowing this writ petition and to quash the notification dated 08.08.2025 (Annexure-2). On the other hand, Learned DSGI, Mr. B. Majumder on behalf of respondent Nos.1, 4 & 5 appeared and submitted that this writ petition was not maintainable because Assam Rifles was not made party in this case and furthermore, all the present petitioners appeared in the physical test and after that they got 14 disqualified and after disqualification, they have approached this Court with the reliefs they sought for which at this stage, cannot be considered and urged for dismissal of this writ petition. It was further submitted by Learned DSGI that petitioner ought to have seek redress before the ensuing date of examination that is prior to 20.08.2025. So, after the test and also after appearance in the test, no cause of action lies with the petitioners to seek any redress before this Court. So, Learned Counsel urged for dismissal of this writ petition. I have heard both the sides and perused the relevant papers. It is the admitted position that the present petitioners after appearing in the physical standard test and physical efficiency test which took place on and from 20.08.2025 to 28.08.2025 where they could not qualify the test, approached this Court seeking redress. Thus, it appears to this Court that the petitioner have failed to make out any case in their favour for interference by this Court and this Court does not find any scope to entertain this writ petition in absence of any valid cause of action and accordingly, the same stands dismissed.
