Neutral Citation No. - 2025:AHC:23746 Court No. - 70 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1279 of 2025 Applicant :- Pradeep Taumar Alias Piddi And Another Opposite Party :- State of U.P. Counsel for Applicant :- Ajay Kumar Pathak Counsel for Opposite Party :- G.A. Hon'ble Deepak Verma,J. 1. Heard Sri Ajay Kumar Pathak, learned counsel for the applicants, learned counsel for the informant, learned A.G.A. for the State and perused the record. 2. The instant anticipatory bail application has been moved by the applicants for enlarging them on anticipatory bail in Case Crime No. 414 of 2024, under Sections 109, 125, 115(2), 352, 351(2) B.N.S., P.S. Kotwali Sasni, District Hathras, during pendency of trial. 3. Allegation in the FIR is that named accused persons assaulted the injured, hence, the present FIR has been registered against the applicants. It is submitted by learned counsel for the applicants that applicants are innocent and have been falsely implicated in the present case due to ulterior motive. Injuries sustained by injured as simple in nature. No offence U/s 109 BNS is made out. Applicant no. 2 has criminal history of one case, the same has been explained in bail application. In case, the applicants are released on bail, they would not misuse the liberty of bail and would co-operate with the investigation. Applicants have definite apprehension of their arrest by the police. 4. Per contra, learned A.G.A. has vehemently opposed the prayer for bail and submitted that applicants are named in the FIR and specific role has been assigned to the applicants. Injured has received grievous injuries and the injuries are supporting the prosecution story. It is not a case of false implication. Hence, the anticipatory bail application of the applicants may be rejected. 5. Considered the arguments raised by learned counsel for the parties and perused the entire record. On perusal of record, it is apparent that the applicants are not co-operating with the investigation, as such, I do not find any good ground for granting anticipatory bail to applicants in the aforesaid case. No interference is warranted. 6. Accordingly, the present anticipatory bail application stands rejected. 7. However, if the applicants surrender before the concerned court within two weeks from today and apply for regular bail, the bail application shall be decided expeditiously by the court concerned, in accordance with law laid down by the Apex Court in Satender Kumar Antil Vs. Central Bureau of Investigation and another; reported in 2021 SCC OnLine SC 922. 8. For the period of two weeks from today or till the time of surrender of the applicants before the court below, whichever is earlier, no coercive action shall be taken against the applicants.
