HIGH COURT OF JUDICATURE AT ALLAHABAD SPECIAL APPEAL No. - 748 of 2025 Court No. - 21 HON'BLE MANOJ KUMAR GUPTA, J.
HON'BLE SIDDHARTH NANDAN, J.
1. Heard learned counsel for the parties. 2. The present intra-court appeal is directed against the order of learned Single Judge dated 09.07.025 by which Writ-A No. 8328 of 2025 (Pankaj Yadav vs. State of U.P. and others) filed by the appellant/petitioner, has been dismissed. 3. The request of the appellant/petitioner for issuing direction to the State- respondents to fix some other date for his physical efficiency test under the U.P. Police Constable Direct Recruitment, 2023, on the ground that he suffered an accident and, therefore, was not in a position to participate in the physical efficiency test scheduled on 18.02.2025, has been rejected. 4. Learned counsel for the appellant/petitioner submits that the appellant/petitioner was advised one month rest by doctor as he suffered sprain in his leg, therefore, was not in a position to participate in the physical efficiency test scheduled on 18.02.2025. The appellant/petitioner alleges to have made request to the respondents through guardian on various dates and by registered post on 18.03.2025 for fixing some other date for his physical efficiency test. The submission is that the same was not considered. 5. Learned Standing Counsel has placed on record the instructions received from the State-respondents. 6. Clause (7) of the advertisement dated 29.01.2025 specifically provided that in case any candidate was unable to appear in the physical efficiency test then he may personally or through some representative make representation on the same day, on which, his physical efficiency test was scheduled and in that event only, his representation would be considered. However, the adjourned date would not be beyond the last date prescribed for completion of the said process.
The relevant part of clause (7) of the Versus Counsel for Appellant(s) : Sher Bahadur Yadav Counsel for Respondent(s) : C.S.C. Pankaj Yadav .....Appellant(s) State Of Uttar Pradesh And 2 Others .....Respondent(s)
advertisement is as follows:
7. Thus, there was specific provision providing for the manner in which request for deferment would be entertained. It explicitly excludes any representation by post, therefore, the representation allegedly sent by appellant/petitioner by registered post for fixing some other date for physical efficiency test, was of no avail. It was, therefore, rightly not taken into consideration.
As regards request made through guardian, learned Single Judge has recorded a finding of fact that there is no cogent material. 8. We also find substance in the stand taken on behalf of the State- respondents that as per the medical certificate filed by the appellant/petitioner along with the writ petition he was advised for bed rest for one month and the said period was beyond the last date of the time table prescribed for physical efficiency test i.e. 27.02.2025. Thus, it was not possible to accede to the request of the appellant/petitioner. 9. As admittedly the selection process has been completed long back and the final results have also been declared on 13.03.2025, therefore, we find no good ground to interfere in the instant appeal. 10. The appeal is dismissed. October 13, 2025 S.Prakash SPLA No. 748 of 2025 2 (Siddharth Nandan,J.) (Manoj Kumar Gupta,J.) Digitally signed by :- SHASHI PRAKASH High Court of Judicature at Allahabad
