HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34003 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. HON'BLE SWARUPAMA CHATURVEDI, J. 1. Heard learned counsel for the parties and perused the records. 2. Petitioner claims to have not been permitted to run a courier service with the respondent No.- 4 despite the fact that she deposited money to the tune of Rs.12,00,000/-. 3. Upon a pointed query being made learned counsel for the petitioner admitted respondent No.- 4 to be a registered company. 4. In our considered view if the petitioner is aggrieved by any breach of terms of contract by the respondent No.4, the proper remedy is either to apply for arbitration under the the terms of the contract or to file civil suit. No writ as such can be issued to the respondent No.- 4 in respect of the breach of contract. 5. Insofar as the investigation being conducted by the respondent No.- 2 is concerned, it will attain conclusion in its own course and investigation would therefore, naturally be brought to its logical end. 6. In our view, no writ as such can be issued for recovery of amount to the tune of Rs.12,00,000/- from the respondent No.- 4 at this stage during investigation and it will all depend upon the final outcome of the investigation for which petitioner should wait. 7. Insofar as status of investigation is concerned, it is always open for petitioner to apply for the same under Right to Information Act, 2005, if Versus Counsel for Petitioner(s) : Radhey Shyam Counsel for Respondent(s) : A.S.G.I., C.S.C., Shiv Kumar Pal Poonam Verma .....Petitioner(s) Union Of India And 3 Others .....Respondent(s) so advised. 8.
