1 2025:CGHC:19646 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 3305 of 2025 Govind Yadav S/o Shri Vijay Yadav Aged About 32 Years R/o Behind Mahobiya Primary School Hanuman Nagar, Mathpara Raipur Police Station Tikarapara, District : Raipur, Chhattisgarh ... Applicant versus State of Chhattisgarh Through - Police Station Station House OfÏcer, Range Cyber Raipur, District : Raipur, Chhattisgarh ... Non-applicant For Applicant : Mr. Rishi Sahu, Advocate. For Non-Applicant/State : Mr. U.K.S. Chandel, Dy. Adv. General Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 30.04.2025 1. This is the second bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 25/2025 registered at Police Station Range Cyber, District Raipur (C.G.), for the offence punishable under Section 420, 34 of the Indian Penal Code. 2. The earlier bail application of the applicant being MCRC No. 2164 of 2025 was rejected by this Court vide order dated 19.03.2025 on the ground that the applicant has committed online fraud against the ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.05.01 12:56:16 +0530 2 complainant. 3. As per the prosecution story in brief, a written complaint was lodged by the complainant alleging that the applicant and other co-accused committed online fraud with the complainant, and accordingly, an offense under Section 420/34 of the IPC has been registered against the applicant. 4. The learned counsel for the applicant submits that the first bail application of the applicant was rejected by this Court on the ground that the applicant allegedly committed online fraud against the complainant. The second bail application of the applicant is being preferred on the grounds that the wife of the applicant is pregnant, the applicant is the sole earning member of the family, and moreover, the investigation has been completed. Therefore, the applicant's continued detention is of no use, hence, he prays for grant of regular bail to the applicant . 5. On the other hand, the learned State counsel opposes the bail application of the present applicant and submits that the present applicant, along with other co-accused, was involved in an online fraud against the complainant, due to which the complainant suffered financial loss, therefore, he is no entitled for grant of regular bail. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. From a perusal of the pleadings, it appears that no new ground has been raised in this second bail application, and since the applicant was involved in online fraud, I do not find any good ground for 3 granting bail, hence, this second bail application of the present applicant is rejected. 8. Accordingly, the second bail application of the applicant – Govind Yadav, filed under Section 483 of the BNSS involved in Crime No. 25/2025 registered at Police Station Range Cyber, District Raipur (C.G.), for the offence punishable under Section 420, 34 of the Indian Penal Code, is rejected. 9. Needless to say that the trial Court concerned, is at liberty to proceed and conclude the trial expeditiously. 10. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/- (Ramesh Sinha) Chief Justice Abhishek
