Heard the learned counsel appearing for the respective parties. 3. The petitioner and the respondent along with their respective counsel have filed the joint memo for settlement for an amount of Rs.1,50,000/- (One Lakh Fifty Thousand only). The petitioner submits that a sum of Rs.30,000/- has been deposited before the trial Court in C.C.No.37/2009 and Rs.70,000/- was paid through DD (DD No.147645) and 3 remaining sum of Rs.50,000/- has been paid through cash. The same is acknowledged by the respondent. 4. In view of the settlement entered between the parties, this revision petition is closed. The judgment of conviction and order of sentence in C.C.No.37/2009 dated 23.09.2019 passed by the Principal Civil Judge and JMFC at Shidlaghatta and order of confirmation in Crl.A.No.58/2019 dated 13.12.2023 passed by the II Additional District and Sessions Judge, Chikkabalapura, sitting at Chintamani are hereby set aside and modified as settled in terms of the joint memo. The petitioner is acquitted for the offence punishable under Section 138 of N.I. Act.
