the applicants submits that since the applicants have already been exonerated during the further investigation and the applicants no.1 and 2 are the unmarried daughters and applicant no.3 is the unmarried son, therefore, they are not beneficiaries of any demand of dowry as the allegation of which has been made in the FIR by the opposite party no.2. Therefore, they having been exonerated by the trial court, no fruitful purpose would be served by keeping the proceeding pending against them.
In support of his submissions, learned counsel for the applicant relies upon the judgment of Apex Court in the case of Geeta Mehrotra v. State of U.P., (2012) 10 SCC 741, Achin Gupta vs. State of Haryana and Another : 2024 SCC Online SC 759 as well as Kahkashan Kausar Vs. State of Bihar, (2022) 6 SCC 599. Per contra, learned counsel for opposite party no.2 has vehemently opposed the application and the prayer made by learned counsel for the applicants. However, he could not deny the fact that pursuant to the order of the trial court for further investigation, the investigation was carried on and the applicants herein were exonerated during further investigation. 5. In view of the aforesaid facts and circumstances of the case, the applicants herein are permitted to file the discharge application within a period of three weeks from today.
