Heard Sri Ram Murti Yadav, learned counsel for the petitioner and learned Standing Counsel for the State respondent. By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of mandamus commanding respondent to ensure that the plot 243 Kha situate at village Bhaisasur, Tehsil Budhanpur, District Azamgarh may not be encroached. In the considered view of the Court, if petitioner is aggrieved by action in the nature of interference over the land of the petitioner by respondents , he can always raise his grievance before appropriate forum by way of common law remedy, if so advised. Hence, we decline to grant indulgence in the matter. However, liberty rests with the petitioner to recourse to common law remedy, if so advised.
