Sri Sandeep Kumar Tiwari, learned counsel for applicant and Shri Kunwar Tejendra Bahadur Singh, learned AGA for the State are present. 2. The instant transfer application has been filed by the applicant with a prayer to transfer the Criminal Misc. Case No. 744 of 2024 (Smt. Pooja Gupta Vs. Pankanj Kumar Gupta), under Section 144 B.N.S.S, Police Station Kotwali City, District Mirzapur pending in the court of Principal Judge Family Court, Mirzapur to any other adjacent District if possible at District Sonbhadra having competent jurisdiction. 3. At the very outset, learned counsel for applicant submits, however, applicant is the husband of the opposite party no.2 and he filed the instant transfer application with the prayer to transfer the trial of the case from District Mirzapur to District Sonbhadra but now applicant is ready to appear through video conferencing and, therefore, instant transfer application may be disposed of with the direction that if applicant filed an application before appropriate forum to appear through Video Conferencing then his application shall be entertained and he will be permitted to appear through Video Conferencing. 4. Learned AGA is having no objection. 5. In view of the contention raised by learned counsel for the applicant, instant transfer application stands disposed of with the direction that that if applicant filed an application to pursue the matter through Video Versus Counsel for Applicant(s) : Sandeep Kumar Tiwari Counsel for Opposite Party(s) : G.A. Pankaj Kumar Gupta .....Applicant(s) State of U.P. and Another .....Opposite Party(s) Conferencing then his application shall be considered and he will be permitted to pursue the matter through Video Conferencing.
