SREENIVASA REDDY £±EminaI Petition Nol5577 of 2025 Order: This Criminal Petition, under Sections 48O and 483 of the BNSS, has been filed by the petitioner/A.1 seeking regular bail, in Crime No.37 of 2025 of A. Koduru Police Station. Anakapalli District. 2. A case has been registered against the petitioner for the offence punishable under Section 20(b)(ii)(B), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, 3. Case of the prosecution, in brief, is I:hat on 25.04.2025 at about ll.00 hours, at Varada Village J'unCtiOn, K. Kolapadu Mandal, the accused while going to DevarapaIIi, was caught by police and found in possession of 1 Kg of Ganja. The SI of Police, A. Koduru arrested the accused and seized the ganja worth of Rs.5000/- , Bajaj PIatina motor cycle and a Samsung cell phone from his possession under the cover of mediators report. 4. Learned counsel for the petitioner submits that the petitioner was falsely implicated in the present crimel The quantity of Ganja allegedly seized-`from the possession of the accused is not a commercial quantity. Material part of the investigation is completed. 5. On the contrary, learned Assistant Public Prosecutor opposed the petition on the ground that the investigation is not completed. L` i+ 6. Heard. Perused the record, 7. The petitioner was arrested and sent to judicial custody on 25.04.2025 and since then he is in jail. The quantity of Ganja allegedly seized from the possession of the accused is 1 Kg, which does not amount to commercial quantity. In view of the aforesaid facts and circumstances of the case, request of the petitioner can be considered for bail. 8. Accordingly, the Criminal Petition is allowed. The petitioner shall be released on bail on executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the like sum to the satisfaction of the learned I Additional District & Sessions Judge-cum- Special Judge for trial of offences under NDPS Act, Visakhapatnam. The petitioner shall appear before the station House Officer concerned on every Sunday between 10.00 AM and 1.00 PM till filing of the charge sheet. //TRUE COPY// sD/-K.
