1. Heard Mr. M. Ahmed, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State.
2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Amzad Ali, has prayed for regular bail in connection with Nagarbera No.24/2025 registered under Sections 61(2)/87/109(1)/336(3) of BNS, 2023.
3. The accused is stated to have been arrested on
24.07.2025. As per the forwarding report, he was forwarded on
24.07.2025.
4. It is submitted by the learned counsel for the petitioner that the accused has completed 61 days as on today and has become entitled to default bail as because the alleged facts falls within the first limb of Section 109(1), wherein the offence is punishable up to 10 years in case hurt is not caused during the offence of attempt to murder.
5. I have perused the FIR and I find that contention to be correct.
6. The learned Additional Public Prosecutor for the State submits that intimation has been received from the I.O seeking another date as he is busy in law and order duty.
7. It is clear that investigation is not yet completed and the
Page No.# 3/3 applicable statutory period will be 60 days.

Accordingly, the above-named accused petitioner is allowed to go on bail of Rs.25,000/- (Rupees Twenty Five Thousand) only with one surety of like amount subject to the satisfaction of the concerned learned court with following conditions: (i) That the accused shall render co-operation to the remaining investigation; (ii) That the accused shall remain available; (iii) That the accused shall not hamper or tamper with evidence.
9. Violation of bail conditions might entail cancellation of the bail.
10. With the above observations, this bail petition stands allowed and stands disposed of.
