This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.97/2025 registered at Police Station – Kawardha, ADITI DIWAN KAIWART Digitally signed by ADITI DIWAN KAIWART Date: 2025.04.28 10:22:05 +0530
2 (MCRCA No. 576 of 2025) District- Kabirdham (C.G.) for the offences punishable under Sections 296, 115(2), 351(3), 126(2), 324(4) and 109 of the BNS Act. 2. Prosecution case, in brief, is that on 08.03.2025, at around 11 PM, when the complainant Ayush Sharma and his friend Shreyas Thakur were on a car returning to home, the applicant who was on a motorcycle, stopped their car and over some old dispute assaulted Shreyas Thakur with a lathi rounded with iron wire and nails, by which he suffered grievous injuries on his head and body. 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in the present case. He would further submit that the injured namely, Shreyas Thakur has suffered injuries which are not fatal and therefore, the offence under Section 109 of the BNS Act would not be made out. It is further submitted that the applicant is a young person aged about 26 years and is pursuing his bachelor degree. The applicant is ready to abide by all the directions and conditions, which may be imposed by this Court while granting anticipatory bail. Hence, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel appearing for the non- applicant oppose the grant of anticipatory bail to the applicant. 5.
Learned counsel for the Objector opposes the grant of anticipatory bail to the applicant and submits that the accused is

He is pressurizing the victim and his family members to compromise and if the accused is granted anticipatory bail then he will cause serious threat for the victim and his family members. Also, the accused attacked the victim with the intention to kill him, which is evident from the injuries sustained by him. Therefore, this anticipatory bail application deserves to be dismissed. 6. I have heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the facts and circumstances of the case, that the allegation leveled against the applicant is grave in nature and that the applicant has assaulted the victim on his head due to which he has suffered grievous injuries, I am not inclined to grant anticipatory bail to the present applicant. 8. Accordingly, the anticipatory bail application of the applicant – Deepak Thakur (Deepak Singh Rajput), filed under Section 482 of the BNSS, 2023 involved in Crime No.97/2025, registered at Police Station – Kawardha, District- Kabirdham (C.G.) for alleged commission of offences punishable under Sections 296, 115(2), 351(3), 126(2), 324(4) and 109 of the BNS Act, is rejected.
