HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 35460 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
HON'BLE SWARUPAMA CHATURVEDI, J. Heard Sri Abhay Mishra, learned counsel for the petitioner and learned Standing Counsel for the State respondent. By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of mandamus commanding respondent no. 2 to renew the passport of the petitioner in the light of the order passed by the Additional Chief Judicial Magistrate, Court No. 3, Moradabad dated 24.4. 2025 in criminal case no. 10417 of 2017, in which the Court has permitted for granting passport to the petitioner expressing its no objection, however his passport has not been renewed on the ground that order does not contain any recital to the effect that the Court was not having any no objection for travelling abroad. In our considered view, the stand taken by the Regional Passport Officer, Bareilly is highly misplaced for the reason that passport is always issued for the purpose of travelling abroad. Under the circumstances, one the criminal court has shown its no objection for grant of passport, the Regional Passport should not have withheld the renewal of passport any further. Accordingly, we dispose of present petition with a direction to the Regional Passport Officer, Bareilly to immediately renew the passport of the petitioner after due verification of the order passed by the Additional Chief Judicial Magistrate on
24.4.2025. An appropriate decision shall be taken by the concerned Regional Passport Officer for the renewal of the passport of the petitioner within a period of one month from the date of presentation of certified copy of this order.
